I think "allowed to come near" depends on how much he trusts them to not try to convince Yuya to run off with them, or to not go "hmmm...if I have the kid(who I will, of course, never in 1000000 million years harm, but rather spoil senseless) then Kyo HAS to fight me to the death..."
Odd thing that just occurred o me: If they have a little girl promptly, the age difference between her and Sasuke wouldn't be much more than that between Kyo and Yuya. Should this happen, Sasuke should likely hope Kyo never realizes that.
